Terms & Conditions

These Terms & Conditions apply to all services provided by Rank & Reach Marketing. By purchasing a package, submitting an enquiry, completing an onboarding form, making payment, or using our services, you agree to the terms set out below.

1. About Rank & Reach Marketing

Rank & Reach Marketing provides local business visibility services, including Google Business Profile setup, profile optimisation, monthly profile management, Google Posts, content support, WhatsApp Channel promotion, directory listings, review support, and selected social media content services depending on the package purchased.

Our goal is to help local businesses improve their online presence, stay active online, and reach more potential customers through relevant digital platforms.

2. Services Provided

The services provided to the Client will depend on the package selected and paid for. Services may include, but are not limited to:

Google Business Profile setup
Google Business Profile optimisation
Verification assistance
Category, service, attribute, and business detail setup
Business description creation or optimisation
Logo and photo uploads
Google Posts, offers, promotions, and updates
Monthly profile maintenance
Basic review monitoring and response support
WhatsApp Channel promotion
Directory listing or featured directory listing
Image creation for posts
Facebook and Instagram content posting, where included in the selected package
Monthly reporting, where included in the selected package
Priority support, where included in the selected package

Any services not specifically listed in the selected package are excluded unless agreed to in writing.

3. Package Scope

Each package includes only the services listed under that package at the time of purchase. The number of posts, updates, listings, reports, revisions, and level of support will depend on the package selected.

Rank & Reach Marketing may update, adjust, or improve its packages from time to time. Any changes to package pricing or inclusions will be communicated where applicable.

4. Paid Marketing Spend Excluded

No Rank & Reach Marketing package includes paid marketing spend, advertising budget, boosted post budget, Google Ads spend, Meta/Facebook Ads spend, Instagram Ads spend, TikTok Ads spend, YouTube Ads spend, or any other paid media budget.

If paid advertising is required, requested, or recommended, it will be quoted and charged separately. The Client will be responsible for paying any advertising budget, platform spend, campaign spend, ad account charges, or related third-party advertising costs.

Management of paid advertising campaigns is also not included unless specifically agreed to in writing and charged separately.

5. Client Responsibilities

The Client agrees to provide all information, access, content, and approvals needed for Rank & Reach Marketing to perform the services.

This may include:

Accurate business name, contact details, trading hours, address, and service areas
Business categories, services, products, descriptions, and pricing where applicable
Website URL and relevant online links
Logos, photos, brand colours, brand guidelines, and other brand assets
Promotional details, specials, offers, events, and announcements
Access to Google Business Profile, Google account, Meta/Facebook pages, Instagram accounts, WhatsApp Channel, or other relevant platforms where required
Approval of content, listings, or profile changes within the requested timeframe
Any information needed for verification, profile updates, directory listings, or content creation

The Client confirms that all information supplied is accurate, lawful, and authorised for use.

6. Access to Platforms

Certain services require access to third-party platforms such as Google, Meta/Facebook, Instagram, WhatsApp, or other online tools. The Client is responsible for providing the required access or admin permissions.

Rank & Reach Marketing cannot be held responsible for delays, incomplete work, or service limitations caused by lack of access, incorrect access, platform restrictions, account issues, verification delays, suspended profiles, or third-party platform changes.

7. Google Business Profile Verification

Google Business Profile verification is controlled by Google and may involve methods such as phone, email, video, postcard, or other verification processes.

Rank & Reach Marketing may assist and guide the Client through the verification process, but we cannot guarantee that Google will approve, verify, reinstate, or publish a profile within a specific timeframe.

Any delays, rejections, suspensions, duplicate listings, ownership disputes, guideline issues, or verification problems caused by Google or the Client’s information are outside of Rank & Reach Marketing’s control.

8. Content, Photos, and Media

The Client must ensure that all logos, images, videos, written content, product information, service information, promotions, and other materials supplied to Rank & Reach Marketing are owned by the Client or legally authorised for use.

Rank & Reach Marketing may create written content, captions, graphics, posts, images, and profile updates using the information and assets supplied by the Client.

Where professional photos or high-quality media are not supplied, Rank & Reach Marketing may use suitable layouts, basic graphics, stock-style visuals, or available client content at its discretion, depending on the selected package.

9. Approvals and Delays

Where approval is required, the Client agrees to respond to approval requests within 48 hours, unless otherwise agreed.

Failure to provide information, access, content, feedback, or approvals on time may delay setup, posting, profile updates, directory listings, reporting, or other services.

Rank & Reach Marketing will not be responsible for missed posting dates, delayed launches, incomplete profiles, or reduced service delivery caused by late or missing Client input.

10. Revisions

Revisions are limited according to the package selected. Reasonable revisions may be made to correct errors, update supplied information, or adjust content before publishing.

Additional revisions, repeated changes, major redesigns, rewritten content, or changes outside the original scope may be charged separately.

Once content has been approved, scheduled, or published, further changes may be treated as additional work.

11. WhatsApp Channel Promotion

WhatsApp Channel promotion is included in selected monthly packages as stated on the package page.

The Client may submit specials, promotions, updates, or business information for possible promotion through the Rank & Reach Marketing WhatsApp Channel. Rank & Reach Marketing may edit submitted content for clarity, professionalism, spelling, layout, length, or suitability before publishing.

Rank & Reach Marketing does not guarantee views, clicks, enquiries, sales, followers, leads, or customer responses from WhatsApp Channel promotions.

Where a package includes the creation of the Client’s own WhatsApp Channel, the Client must provide all required business information, branding, access, and approvals. Ongoing posting or management of the Client’s own WhatsApp Channel is only included if specifically listed in the selected package.

12. Directory Listings

Directory listing or featured directory listing is included only where stated in the selected package.

The Client is responsible for supplying accurate directory listing information, including business name, contact details, category, location, service area, description, images, website links, and any other required details.

Rank & Reach Marketing may edit directory listing content for spelling, layout, formatting, clarity, and professionalism.

Rank & Reach Marketing reserves the right to refuse, edit, suspend, or remove any listing that is inaccurate, misleading, unlawful, inappropriate, unpaid, or in conflict with the purpose of the directory.

Directory listings are intended to provide extra visibility but do not guarantee leads, enquiries, sales, ranking positions, customer engagement, or business results.

13. Social Media Services

Where included in the selected package, social media services may include content creation, graphic design, caption writing, post scheduling, publishing, and basic performance tracking.

Social media services apply only to the platforms and number of posts listed in the selected package.

Unless specifically agreed in writing, social media services do not include community management, inbox management, comment moderation, influencer marketing, video production, paid ad campaign management, boosted posts, photography, videography, or daily posting.

14. Review Support

Rank & Reach Marketing may assist with basic review support, review response guidance, review prompts, or review monitoring depending on the selected package.

The Client remains responsible for customer service, customer experience, and the accuracy of review responses.

Rank & Reach Marketing does not create fake reviews, purchase reviews, guarantee positive reviews, or guarantee removal of negative reviews. Review activity is subject to the rules and policies of the relevant platform.

15. No Guarantee of Results

Rank & Reach Marketing will make reasonable efforts to improve the Client’s online visibility and professional online presence.

However, results depend on many factors outside our control, including competition, location, industry, search demand, customer behaviour, platform algorithms, review activity, website quality, business reputation, and third-party platform rules.

Rank & Reach Marketing does not guarantee:

First-page Google rankings
Specific Google Maps positions
A specific number of leads
A specific number of phone calls
A specific number of website visits
A specific number of bookings
A specific number of sales
A specific amount of reach, engagement, or followers
Approval, verification, reinstatement, or continued publication by any third-party platform

16. Payments

Payment must be made according to the package selected.

Once-off setup packages are payable upfront before work begins.

Monthly packages are billed monthly and are payable in advance unless otherwise agreed in writing.

Work may only begin once payment has been received and the required onboarding information has been submitted.

The Client must use the correct payment reference when making payment.

17. Monthly Subscriptions and Cancellation

Monthly packages operate on a recurring monthly basis unless otherwise agreed.

The Client may cancel a monthly package by giving 30 days’ written notice.

Services will continue during the paid notice period, provided the Client’s account is up to date and all required access and information remain available.

Rank & Reach Marketing reserves the right to suspend or stop services if payment is late, missed, reversed, or not received.

18. Late Payments and Suspension

If payment is not received by the due date, Rank & Reach Marketing may pause all services until payment has been made.

This may include pausing posts, profile updates, WhatsApp Channel promotions, directory listings, reporting, content creation, or support.

Rank & Reach Marketing will not be responsible for delays, missed posts, reduced visibility, or incomplete work caused by late payment.

19. Refunds

Payments are generally non-refundable once work has started, onboarding has been reviewed, setup has begun, content has been created, or services have been delivered.

Refunds, where applicable, will be considered at the discretion of Rank & Reach Marketing and may exclude any work already completed, time spent, platform fees, payment processing fees, or third-party costs.

Monthly subscription payments already processed are non-refundable for that billing period.

20. Ownership of Content

Final content created by Rank & Reach Marketing becomes the property of the Client once full payment has been received.

Rank & Reach Marketing retains ownership of any internal templates, systems, processes, draft concepts, working files, strategy documents, design methods, and unpublished materials unless otherwise agreed in writing.

Rank & Reach Marketing may use completed work, screenshots, designs, posts, directory listings, or marketing examples for portfolio, promotional, or case study purposes unless the Client requests otherwise in writing.

21. Third-Party Platforms

Rank & Reach Marketing works with third-party platforms such as Google, Meta/Facebook, Instagram, WhatsApp, and other online services.

These platforms have their own rules, policies, algorithms, approval systems, verification processes, and technical limitations.

Rank & Reach Marketing is not responsible for changes, outages, restrictions, suspensions, account issues, rejected content, reduced reach, removed listings, policy changes, or performance changes caused by third-party platforms.

22. Client Warranties

The Client confirms that:

All information supplied is true and accurate
The Client has the authority to represent the business
The Client has permission to provide access to relevant accounts
The Client owns or has permission to use all supplied logos, images, videos, written content, and brand assets
The Client’s products, services, claims, pricing, and promotions are lawful and accurate
The Client will not ask Rank & Reach Marketing to publish misleading, unlawful, offensive, discriminatory, or prohibited content

23. Limitation of Liability

Rank & Reach Marketing will not be liable for any indirect, incidental, special, or consequential loss, including loss of profits, loss of sales, loss of business, loss of data, loss of reputation, loss of rankings, loss of leads, or loss of opportunity.

Rank & Reach Marketing’s total liability for any claim will be limited to the amount paid by the Client for the specific service giving rise to the claim.

24. Confidentiality

Both parties agree to keep confidential information private and not disclose it to third parties unless required for the delivery of services, required by law, or agreed in writing.

Confidential information may include business information, account access, marketing plans, customer information, pricing information, and unpublished content.

25. Personal Information

Rank & Reach Marketing may collect and process business and contact information in order to provide services, communicate with the Client, manage accounts, process payments, create listings, and publish approved content.

The Client agrees that Rank & Reach Marketing may use the information supplied for the purpose of providing the selected services.

Rank & Reach Marketing will take reasonable steps to protect personal information and handle it in accordance with applicable South African privacy laws, including POPIA where applicable.

26. Termination

Rank & Reach Marketing may terminate or suspend services if the Client:

Fails to make payment
Fails to provide required information or access
Provides false or misleading information
Requests unlawful, offensive, or prohibited content
Abuses staff or acts in bad faith
Breaches these Terms & Conditions

The Client remains responsible for payment of any services already provided or work already completed.

27. Changes to Services or Terms

Rank & Reach Marketing may update these Terms & Conditions from time to time. Updated terms will apply from the date they are published or communicated.

Continued use of Rank & Reach Marketing’s services after updated terms have been published will be considered acceptance of the updated terms.

28. Governing Law

These Terms & Conditions are governed by the laws of the Republic of South Africa.
